AI in Human Resources: Improving Efficiency While Respecting Fundamental Rights

Artificial intelligence has made a strong entry into human resources departments, but its efficiency cannot justify the violation of fundamental rights. In Spain, many companies that delegate labor decisions to algorithms assume legal risks that they often do not fully assess.
Automation is already a daily reality: filtering resumes, evaluating performance, anticipating turnover, measuring productivity, or classifying candidates are tasks that AI performs in numerous organizations. This technology promises agility, savings, and objectivity in traditionally complex processes, but it also introduces an increasing legal risk.
When AI intervenes in decisions affecting access to employment, career advancement, or job continuity, the debate transcends technology and enters the realm of fundamental rights and corporate responsibility.
There is a false belief that technology is neutral. However, AI systems learn from historical data and can reproduce the biases present in that data. If an algorithm discards profiles, prioritizes indirectly discriminatory variables, or penalizes atypical career paths, the problem is not just technical but legal.
Principles such as equality, non-discrimination, and the dignity of workers are at stake, as well as the right not to be subject to solely automated decisions, as stated in Article 22 of the GDPR. Additionally, Spanish labor legislation requires transparency when algorithms affect working conditions, reinforcing companies' obligation to explain how these decisions are made.
The European AI Regulation (AI Act) raises the requirements even further. It considers systems used for personnel selection, performance evaluation, internal promotion, or layoffs as high-risk, which implies obligations such as prior risk assessment, technical documentation, decision traceability, and effective human oversight.
A formal validation of the algorithm's result is not enough; there must be a real capacity for intervention and correction. Many SMEs are unaware that the tools they use may be subject to these obligations, but ignorance does not exempt them from responsibility. The rapid adoption of technological solutions, driven by competitive pressure and the pursuit of efficiency, is creating an environment where innovation is advancing faster than legal reflection.
Another common mistake is thinking that responsibility lies with the technology provider. The European regulatory framework distributes obligations between developers and users, and companies must demonstrate that they have acted diligently.
If a candidate challenges a selection process for discrimination, if a worker questions an automated evaluation, or if the Labor Inspectorate requests explanations about the algorithm's criteria, the company cannot simply point to the provider. It must prove that it assessed the risks, established oversight mechanisms, and took measures to protect the affected rights. Software does not answer to the courts; responsibility remains human and corporate.
Therefore, it is essential to integrate artificial intelligence into the compliance system. This is not about adding bureaucracy but ensuring prior legal audits, impact assessments on data protection and fundamental rights, clear internal protocols, effective human oversight, and specific training for executives and HR managers.
When an algorithm decides who gets an interview, who gets promoted, or who is excluded from a process, it directly influences individuals' career paths. The company must be able to explain what variables the system uses, how it was trained, what controls exist to detect biases, and what margin for human intervention is planned. Opacity is no longer compatible with a regulatory environment that demands transparency and accountability.
Artificial intelligence can be a strategic ally for business competitiveness, but only if it is integrated into a framework of responsible governance and regulatory compliance. Delegating to algorithms does not exempt one from responsibility; it increases it.
Human oversight, legal auditing, and the management of algorithmic risks are not obstacles to innovation but guarantees to protect rights, avoid sanctions, and preserve corporate reputation in an increasingly demanding environment. In a market where employer branding and internal trust are key assets, the perception of opaque or unfair automated decisions can become a real competitive disadvantage.
Efficiency must not compromise the dignity of individuals. In the age of AI, compliance is not just about adopting advanced technology but doing so with criteria, transparency, and responsibility. Because, although the algorithm decides, the company remains responsible.
