The bill S7263, sponsored by Senator Kristen Gonzalez, proposes to amend state legislation to hold platforms accountable when a chatbot impersonates a regulated professional and causes harm. The text goes beyond a simple prohibition: it seeks to prevent chatbots from providing answers or advice that, if given by a person, would constitute unauthorized practice of a regulated profession. Additionally, the proposal would allow affected users to sue the company owning the AI system directly. This approach represents a significant shift from the current situation, where many platforms rely on disclaimers like "this does not replace professional advice." However, the New York initiative aims to close that loophole: according to Reuters and the legislative text itself, warning that it is a chatbot would not exempt liability if the AI acts as if it were an authorized professional. The measure is not limited to the legal field but also covers other professions regulated by the state, such as medicine or mental health. This comes amid growing concern among lawmakers about how conversational AI models are penetrating sectors traditionally reserved for accredited experts. The state Senate's Internet and Technology Committee has already approved the bill, which is part of a broader package of AI regulations. The debate has intensified following the recent lawsuit by Nippon Life Insurance Company of America against OpenAI, accusing ChatGPT of acting as an unlicensed lawyer and contributing to the filing of baseless court documents. Although OpenAI denies the allegations, the case illustrates the types of situations that New York legislation seeks to prevent. In summary, the proposal aims to transform a widespread concern into a concrete norm: it is not enough for AI to identify as non-human; it also cannot assume the role of a professional authority to influence sensitive decisions.
